Terms of Service

1. The Service

AugmentedRetrieval is a Retrieval Augmented Generation (RAG) framework that processes documents through AI models to generate embeddings, then immediately deletes the original documents from our infrastructure. Embeddings may be stored in your vector database of choice.

The Service is provided "as is" during the Beta Program and subject to ongoing development.

2. Eligibility & Account

• You must be at least 18 years old and capable of entering legally binding contracts.
• If using on behalf of an organization, you warrant authority to bind that organization.
• You are responsible for maintaining the confidentiality of your credentials.
• You must provide accurate registration information and keep it current.

3. Acceptable Use

You agree NOT to:

• Use the Service for unlawful purposes or in violation of applicable laws
• Submit content that infringes third-party intellectual property or privacy rights
• Submit illegal content, including but not limited to CSAM, hate speech, or content designed to harm others
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Probe, scan, or test the vulnerability of the Service without authorization
• Use the Service to train competing AI models
• Resell, sublicense, or redistribute the Service without written permission
• Exceed API rate limits or attempt to circumvent usage controls

We reserve the right to suspend or terminate accounts that violate these terms.

4. Your Content

• Ownership: You retain all rights to documents and content you submit ("Customer Content").
• License to us: You grant AITEST a limited license to process Customer Content solely to provide the Service. This license terminates upon deletion.
• Warranties: You warrant that you have the rights to submit Customer Content and that doing so does not violate any law or third-party right.
• Indemnity: You will indemnify AITEST against claims arising from Customer Content you submit in violation of these Terms.

5. Our Intellectual Property

The Service, including its software, design, branding, documentation, and all related materials, is the exclusive property of AITEST SRL and protected by applicable IP laws. No rights are granted to you except as expressly stated.

6. Beta Program

If you are participating in the Beta Program:

• The Service may be unstable, contain bugs, or change without notice.
• No SLA or uptime guarantees apply.
• We may collect additional feedback and usage data to improve the Service.
• The Beta Program may be terminated at any time.
• Pricing during Beta does not guarantee future pricing.

7. Fees & Payment

• Fees are described on our pricing page (or in your individual Order Form).
• Payments are processed by Stripe.
• Fees are exclusive of VAT, which will be added where applicable under Romanian/EU law.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are at our sole discretion except where required by law.
• Late payments may result in suspension of service.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated outputs will be accurate, complete, or fit for any specific purpose
• Defects will be corrected

You are responsible for verifying AI-generated outputs before relying on them for any consequential decision.

9. Limitation of Liability

To the maximum extent permitted by law:

• AITEST's total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amounts paid by you to AITEST in the 12 months preceding the claim, or €100, whichever is higher.
• AITEST shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity.

Nothing in these Terms excludes liability for gross negligence, willful misconduct, or matters that cannot be excluded under Romanian law.

10. Termination

• You may terminate your account at any time via account settings or by emailing us.
• We may suspend or terminate your account for material breach of these Terms with 30 days written notice, except for serious violations (illegal use, security risk) which may result in immediate termination.
• Upon termination, your right to use the Service ceases. Sections 4, 5, 8, 9, 11, and 12 survive termination.

11. Governing Law & Disputes

These Terms are governed by Romanian law, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Constanța, Romania, except where mandatory consumer protection laws provide otherwise for EU consumers.

For EU consumers, the European Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

12. Changes to Terms

We may modify these Terms from time to time. Material changes will be notified at least 30 days in advance via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
